GENERAL RENTAL TERMS AND CONDITIONS
1- RENTING
Bookings are made as agents for the owner of the property at the prices indicated on the price list, which accompanies the property information of VILLATORENT (VTR). The prices are based on current market conditions and are expressed in the Euro currency. The services of VTR are exclusively those expressed on the present contract.

2- PAYMENTS PROCEDURES
Once the property availability is confirmed, you will be requested to pay 25% of the rental amount. This is applied to the total balance. The remaining balance (75%) is required 60 days prior to the date of arrival.
Non payment of the balance by the due date will constitute basis for cancellation and the property will be re-offered and cancellation conditions applied.
For reservations made less than 60 days before arrival date, the full rental amount (100%) is due at time of booking.
The booking deposit is required in Euro and can be paid in the following ways:

Bank transfer in Euro. Clients are responsible to pay their bank transfer fees; in order to expedite the booking, a copy of the bank transaction should be sent to us e-mail.
Credit card (Visa or MasterCard), through our Secure credit card payment system.
3- CANCELLATION POLICY
In case of a cancellation made by the guest, even if it is substituted by another one,the following terms and conditions are applied:

If a Cancelation is made after a Booking on OTA such as, Airbnb, Booking, etc, we hereby compromize to respect the Cancelation Policy as on the confirmation.

For direct Bookings, if the cancellation is made after the payment of the Booking deposit of 25% of the Total Rental Price, this amount will not be returned as forfeit of deposit;
If cancellation is made from the day of the Payment of the Rental Balance until 31 days the start of Rental Period, the penalty is the 75% of Total Rental price.
If a cancellation is made from less of 31 prior to arrival date, the penalty is the 100% of the total rental price.
Cancellations should be sent by e-mail to [email protected]. Once the email is received, we will send you the confirmation of your cancellation.
We suggest you the Booking Refund Protection, available on our website!
Clients are strongly advised to take out adequate insurance to ensure that they are protected from unforeseen events which may give rise to cancellations.

4- MINIMUM RENTING PERIOD AND PRICES
The minimum renting period is generally one week, from Saturday to Saturday.
In some cases, and depending on the season and/or time of year, a rental period of less than one week is accepted.
In particular cases, VTR reserves the right to accept only bookings of a minimum two weeks in the months of July and August. The rental price is per week and per property, and expressed in Euros.

5– CHECK-IN & CHECK-OUT
Check-in time: Saturday between 4:00pm and 8:00pm, or by different arrangement communicated by phone or email.
Check-out: Saturday between 8:00am and 10:00am. Any changes in check-in or check-out time must be communicated to [email protected] and be approved by VTR at least 48 hours in advance.
In case of unavoidable and/or unforeseeable delay(s) of check-in by the guest, the guest must email, call or text VTR to notify VTR of the delay(s).
VTR always does everything it can to meet the guests upon arrival at the property. In the event that the property owner cannot be found or if the guest fails to arrive within the time period stipulated and has not communicated the delay to VTR, the owner, or his/her representative, VTR declines all responsibility.

6- UPON ARRIVAL
Upon arrival to the property, the client must show the Booking confirmation and passport or identity card to the owner or his/her representative to enable them to proceed with the necessary registration required by Italian law.
The Client acknowledges that the following circumstances provide the Owner or the Company with a basis for the immediate termination of the rental agreement without recourse by the Client and forfeiting all moneys paid to the Company:
Exceeding the maximum number of guests as noted on the voucher;
Non authorized substitution of guests – the names and passport details of all guests must be provided to the property representative (to comply with Italian Law)
Conduct unbecoming at the property (including wanton destruction of property, poor hygiene, excessive noise etc)
Parties, weddings, celebrations unauthorized or involving non guests
Introducing domestic animals (unless allowed in the property notes and advised to the Company)

7- SECURITY DEPOSIT
Before the client takes possession of the keys to the property, the security deposit, as stipulated in the property description, must be paid by cash or traveler’s cheques in Euros, US Dollars, or British Pound to VTR, the owner, or his/her representative. Such amount will be refunded at the end of the holiday, less any deduction for any damage caused to the property, or for any additional cost not included in the rental price. THE OWNER OR HIS/HER REPRESENTATIVE MAY REFUSE ACCESS TO THE PROPERTY IF THE DEPOSIT IS NOT MADE.
Should the client decide to leave the property prematurely, the owner or his/her representative is authorized to refund the security deposit (less any eventual deduction for damages) to the guest by post, only after having checked the inventory and the property. VTR declines all responsibility in the case of dispute between the guest and the owner regarding the deposit.

8- NUMBER OF PERSONS/SUBSTITUTIONS
The number of persons (adults and children) staying at a property must not exceed the number of sleeping places indicated in the property information, except in the case of infants (0-2 years old) for whom the client brings a travel cot and necessary linens. Any exceptions are stated in the property description. Any substitution during the rental period is forbidden, if not previously agreed upon.

9- ORDER – CLEANING – MAINTENANCE – HEATING
The properties will be handed over clean and tidy and in good working order. For some properties, and when stated, the guest is obliged to pay a cleaning cost to the owner or his/her representative. The amount due for the cleaning is shown on the price list of the property. This amount does not, however, include the cleaning of the kitchen corner/the kitchen/the kitchenette with regard to dirty dishes, pots and pans, counter-top, etc., nor the removal of rubbish, which are the guest’s responsibility. If this has not been done, the owner or his/her representative may charge additional expenses, in addition to the regular cleaning cost.
Given the situation regarding energy supply and the current laws in Italy, the use of heating (when it can be switched on and off, temperature, etc.) is controlled by regulations that vary from region to region. For example, heating may be turned on from November to April. Costs for linens in some properties have to be paid to the owner according with the price written in the property description.

10- EXTERNAL MAINTENANCE
The owner or his/her representative, if necessary, may access the external areas of the property (garden, swimming pool, etc.) for essential maintenance purposes.

11- RESPONSIBILITY
VTR has visited and checked each property. The descriptions appearing in our property information are accurate and have been done in good faith. However, VTR declines all responsibility for any modifications made by the owners without our knowledge. VTR is not responsible for any physical injuries caused to the guests and/or their visitors during their stay at the property. It is, therefore, highly recommended that the guests and visitors purchase comprehensive travel insurance prior to their trip.
In the event of any problems, the guests must do their best to solve or minimize the problem in order to avoid hazardous, costly, and/or negative consequences that could result. If this is impossible for the guest, he/she must immediately get in touch with VTR by telephone or by email (tel. +39 3392815129 or [email protected]) and then confirm the complaints in writing within 24 hours.
The guest is obliged to give VTR the necessary time to resolve the problem. Any person who leaves the property prematurely without any explicit authorization by VTR and without having sent notice in writing as mentioned above, will forfeit any right to an eventual refund of the rental cost. No complaint presented upon the return of the holiday will be taken into consideration, nor will give rise to any indemnity. No request for indemnity presented on the day of departure or thereafter will be taken into consideration. If for any reason beyond its control, including force major, VTR is unable to provide to the client the property he/she has booked, VTR reserves the right to transfer him/her, upon agreement, to a similar property. If the price of the substituted property is less, the difference will be reimbursed to the client but if the price of the substituted property is higher, the difference will be charged to the guest. If, however, no agreement can be reached, both contractual parties are authorized to cancel the contract. VTR will refund to the guest only the rental price he/she paid. Any other kind of refund is excluded.

12- PROPERTIES
It is understood that the properties VTR is offering are private homes, and not always official tourist structures, such as hotels, residences, etc. Being such, the properties do not have standards or categories recognized internationally. Rather they reflect, in their architecture and furnishings, the local traditions and personal taste of the owner. This is precisely the kind of holiday that VTR is offering: to enter right into the culture of the area, living for a few weeks in the same surroundings as someone from the area. In order to experience this in the right spirit, it is important that you accept it, and know how to appreciate any differences in the properties VTR is offering, in comparison with those properties where you normally live. For its part, VTR has been careful to choose such properties using a minimum and maximum quality range, so that any citizen of Europe, and indeed of the world, can find satisfaction. VTR cannot exclude, however, the possibility that these differences may result in minor inconveniences that are connected to the particular characteristics of the architecture and of the traditions of the area. These possible inconveniences cannot be accepted as complaints.

13- DISCLAIMER
VTR does not accept any liability for any loss, damage, or additional expenses incurred by the guests or any member of the guests’ party, regardless of the cause. VTR does not accept liability for any injury, death, loss, inconvenience or damage, alteration, delay or cancellation of the booking as a result of war, threat of war, riot or civil strife, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns or with the guests’ accommodation or other circumstances as amounting to ‘force majeure’ or Acts of God or other similar events beyond VTR’s control.

14- JURISDICTION
In the event of controversy arising from the booking and the renting, only the Courts of Law of Sorrento and the provisions of Italian Civil Law can deal with the matter and only Italian law applies. Making the booking implies that VTR’s General Conditions have been understood and have thereby been accepted without reserve and without exception. If any of the conditions of this contract have become invalid or were invalid or if in this contract there should be a gap, the other conditions cannot be contested.

15- OTHER INFORMATION
If applicable, the cleaning, heating (including firewood), and/or electricity costs, or others expenses in some properties, are to be paid directly to the property owner at arrival or prior to departure. The amount for these occurrence and more details are always indicated for each property in the rental rules.

16- VERY IMPORTANT!
From 01.07.2011 many Italian towns have introduced a tax for non-residents who stay in their area. The amount of the tax varies from 1 to 5 Euros per person, per night, depending on the category of the property.
Since this tax is levied on the renters, you may be asked to pay this tax at the end of your stay.

According to the local City Council resolutions, from April the 1st to October the 31st of each year the tourism tax is applied to non-residents overnight staying, for a maximum of 7 consecutive nights. The tourism tax rate in non-hotel accommodations (such as B&B or Holiday Homes) is € 4,00 in Sorrento city and € 4,00 in Sant’Agnello, per person per night and it is not applied to children up to 18 years old. The collected funds will help the City improve the quality of the tourist services and finance works aimed at maintaining, using and salvaging the city’s cultural.
